Goods are sold via the website www.catya.it in accordance with the following conditions:
1. SELLER

2. BUYER
Any adult may order goods shown in the online catalogue. The buyer is obliged, subject to their own liability for false or incomplete declarations, to provide to CATYA SRL their personal and fiscal details.
3. PURCHASE OFFER
Publication on the www.catya.it website of individuals products, with their respective description and price, constitutes only and exclusively an offer invitation.
The buyer may order items published in the online catalogue by completing the following steps:
select and add to your basket the products you wish to purchase, identifying their size, colour and quantity, by clicking the "ADD TO SHOPPING BAG" icon next to each product;
check the accuracy of the data (in particular the number, size and colour of each ordered item) included on the order form;
send the order to CATYA SRL by clicking the "PROCEED" icon and checking out;
register on the site by clicking the "REGISTER" icon and provide all requested details (or, if already registered, log in by entering your username and password);
select the "ACCEPT SALE CONDITIONS" icon and then "PROCEED";
click the "CONFIRM" button;
pay for the ordered goods by selecting the preferred method from those available (advance bank transfer, credit cards or Pay Pal);
Once the transaction has been successfully completed, the screen will show a notification stating that the order has been sent.
4. CONTRACT FINALIZATION
Once the order has been received, CATYA SRL shall inform the buyer, by way of e-mail to the address identified on the order form, whether or not the order is wholly or partially accepted. The contract shall in any case be finalized only upon receipt by the buyer of an order confirmation from CATYA SRL
5. PARTIAL ACCEPTANCE OF ORDER
Where, due to stock shortage or other reasons, CATYA SRL is only able to accept part of the order received, it shall inform the buyer within the order confirmation. Unless otherwise notified by the buyer within 10 days of receiving the order confirmation, the contract shall be deemed to be finalised only for the sale of the goods identified within the order confirmation and CATYA SRL shall return to the buyer the cost of the other goods.
6. SENDING THE ORDER CONFIRMATION
Any information relating to the order and the contract shall be notified to the buyer by way of email and shall be stored in the CATYA SRL database. In the event of non-delivery or accidental loss, the buyer may request a copy of such by writing to selenecalori@catya.it
7. DELIVERY
CATYA SRL will send the goods by way of courier to the buyer within 30 days from the day after the order is sent. In the case of replacements or modifications, agreed in accordance with point 8, to the ordered items, the delivery period shall commence from the date of agreement to the modification.
8. CONTRACT MODIFICATIONS
Any modifications to the number of goods, their size, colour and any other contractual element must be agreed between the parties. To this end, the buyer must contact CATYA SRL trough the email address selenecalori@catya.it or by recorded delivery letter with acknowledgement of receipt sent to CATYA SRL VIA DELL'ELETTRICISTA 8 40138 BOLOGNA ITALY
9. PRICE
The price must be paid when the order is sent; CATYA SRL shall not process any order unless payment has been received for the ordered goods, delivery costs and any other charges.
10. SHIPPING
Shipping costs, as specified in the order form, shall be paid by CATYA SRL The buyer shall be responsible for the risks of loss and/or damage to the goods once they have been shipped by CATYA SRL
11. TAXES AND CUSTOMS DUTIES
Where the ordered goods are to be delivered to non-EU nations, any taxes and/or duties and/or customs clearance (as well as any ancillary costs, of any nature) shall be borne by the buyer.
12. RIGHT OF WITHDRAWAL
The buyer may withdraw from the contract within 10 working days from receipt of the goods, pursuant to Articles 55 and 64 et seq Italian Legislative Decree dated 6 September 2005, No. 206 ("Consumer Code").
13. EXERCISING THE RIGHT OF WITHDRAWAL
Should buyer intend to withdraw from the contract, he must provide notification of such by way of recorded delivery letter with acknowledgement of receipt sent to CATYA SRL VIA DELL'ELETTRICISTA 8 40138 BOLOGNA ITALY and return the goods to the company within 10 days from the date of delivery. The goods must be returned to CATYA SRL. intact, complete with any accessories, with the original labelling and packaging; withdrawal from the contract shall not, therefore, be permitted where items have been damaged or even just used, where the labelling has been altered or removed or in any case where the items are not in the same condition in which they were sent to the buyer. The costs of returning the goods to CATYA SRL, if in respect of these conditions, shall be borne by CATYA SRL.
14. RETURN OF THE PRICE
In case of legitimate exercise of the right of withdrawal, CATYA SRL will reimburse the buyer for the price of the delivered goods, (shipping cost paied by Catya srl) - excluding any additional costs incurred (including those mentioned in point 10) - within 30 days of Receipt of the goods. Nothing shall be due if the right of withdrawal was exercised after the expiry of the deadlines set out in point 11 or the goods were not returned under the conditions laid down in point 12.
15. PARTIAL WITHDRAWAL
The buyer may exercise the right of withdrawal even for just part of the ordered goods. In that case, the buyer must identify, within the declaration of withdrawal, the individual goods for which the right of withdrawal is to be exercised and must return them to CATYA SRL must consequently refund to the buyer only the cost of the returned goods.
16. COMPLAINTS
Any complaints must be sent by way of recorded delivery letter with acknowledgement of receipt to CATYA SRL VIA DELL'ELETTRICISTA 8 40138 BOLOGNA ITALY
17. MEDIATION
Any disputes between the seller and the buyer may be settled by way of recourse to the mediation procedure set out by the Consumer Code (Italian Legislative Decree No. 206/2005).

Before or after finalisation or implementation of the contract, the buyer may request assistance from CATYA SRL by telephone on +39 051 532666 by email at selenecalori@catya.it or by post, by way of recorded delivery letter with acknowledgement of receipt to CATYA SRL VIA DELL'ELETTRICISTA 8 40138 BOLOGNA ITALY
19. BUYER'S RIGHTS
As a consumer pursuant to Italian Legislative Decree No. 206/2005, the buyer has the rights contained in Chapter I, Section II, Italian Legislative Decree No. 206/2005.
20. ACCOUNT PROTECTION
The buyer is obliged to keep his login and password secret and, in general, to take all necessary precautions to prevent unauthorised access to the site by way of his account; in the event of a breach of this secrecy, the buyer is obliged immediately to inform CATYA SRL of such. The buyer is in any case responsible for all activities that are carried out, even by unauthorised third parties, on his account and with his password.
21. PRIVACY
By sending the order, the buyer authorises CATYA SRL to process his personal data, solely for the purposes of processing the order and registering the sale in the accounts. The buyer may correct any errors in data entry and may alter his personal details by logging in to the website.
22. LANGUAGE AND APPLICABLE LAW
The contract may be finalised in Italian or English; in any case, only the Italian text of the contract shall be relied upon. These general conditions and the individual sale contracts are regulated by Italian law.
